Welcome to EZpresence ("we", "us", "our").
These Terms of Service ("Terms") govern your use of the EZpresence platform, website, and related services (collectively, the "Service").
By accessing or using EZpresence, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

1. About EZpresence

EZpresence is an AI-powered social media management and creative platform designed to help creators, entrepreneurs, and brands manage and grow their presence on social media.
Our platform enables users to:

Connect multiple social media accounts (such as TikTok, YouTube, Instagram, and Facebook),
Schedule, publish, and analyze performance metrics over time, and
Create and enhance content (focused on short-form videos) through our Studio environment.

The EZpresence Studio is a creative space focused on 9:16 video content (stories, reels, and shorts). It allows users to generate professional-quality videos using AI-driven tools and algorithms based on user intent.
Studio features include content creation assistants, video enhancers known as "Wizards" (such as automatic captioning, AI voice-overs, AI avatars, and branded outros), and access to next-generation AI video experiences leveraging text-to-video models (e.g., Sora, Veo, and others).

EZpresence is owned and operated by EZpresence, a company operating under Israeli law.

2. Eligibility and Account Responsibilities

EZpresence is intended for use by businesses, creators, and professionals managing social media accounts. By using the Service, you confirm that you are authorized to manage or represent a business, brand, or creator account on the connected platform. Users must be at least 16 years old, or meet the minimum age of digital consent in their country, to use the Service.

If you suspect unauthorized access to your account, you must notify us immediately at contact@ezpresence.com.

3. Subscriptions and Billing

EZpresence offers both free and paid plans.

Free Tier: Limited access to certain features to help users explore the platform.
Subscription Plans: Paid plans grant extended functionality, billed according to the selected plan at the time of purchase.

Payments are processed through secure third-party payment processors.
You authorize EZpresence (and our payment partners) to charge your chosen payment method for applicable fees.
All fees are non-refundable unless required by law.

4. Connecting Social Media Accounts

EZpresence connects exclusively to Business, Creator, or Professional accounts via each platform's official APIs (such as TikTok for Developers, Meta for Developers, YouTube Data API, Instagram Graph API etc.). When you connect an account, you authorize EZpresence to securely access and process data that the connected platform explicitly permits — for example, profile details, performance metrics, media uploads, and engagement statistics. EZpresence only collects and stores information necessary to deliver its features, including analytics, scheduling, publishing, and creative tools (such as AI-generated captions, video enhancements, or automated post scheduling). You can revoke data access at any time directly from the connected platform's settings (e.g., TikTok, YouTube, or Meta). EZpresence never accesses private user data (such as messages, personal contacts, or non-public account details) and never shares or sells data to third parties.

5. Data Handling and Security

We take your privacy and data security seriously.

Data retrieved via social media integrations is stored securely on enterprise-grade cloud infrastructure and used solely to support your analytics dashboards, content scheduling, and creative workflows.
Video content you create within Studio or upload to EZpresence — including externally sourced media — is stored in your account so you can manage, enhance, schedule, publish, and view it in the Content section of the platform. You may delete this content at any time from within EZpresence; residual copies may remain in backups for a limited period consistent with our retention practices.
We may retain certain aggregated data to improve system performance, insights, and AI models over time.
EZpresence does not share, sell, or disclose user data to external parties, advertisers, or data brokers.
You can delete your content directly from the Content section by choosing Delete. Deletions are soft-deleted for a short retention period (to allow recovery) before being permanently removed from active systems.

6. Acceptable Use

By using EZpresence, you agree not to:

Upload or distribute content that is unlawful, harmful, abusive, or infringes on others' rights.
Use AI video tools or Wizards to create misleading, deceptive, or harmful media.
Attempt to interfere with or disrupt EZpresence's services, systems, or APIs.
Use the platform for spamming, automation abuse, or unauthorized scraping.
Reverse-engineer or attempt to extract source code from our platform or connected APIs.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable platform policies (e.g., TikTok, Meta, YouTube).

7. User-Generated Content

You retain full ownership of the content you upload, create, enhance, schedule, or publish through EZpresence.
By using the platform, you grant EZpresence a limited, revocable license to process, store, enhance, and display your content as needed to deliver our services (such as scheduling, analytics, or video creation).

You are solely responsible for the legality and originality of the content you produce through EZpresence, including any media generated by AI tools or Wizards.

EZpresence does not claim ownership of your social media content or intellectual property.

8. Studio and Creative Features

The EZpresence Studio allows users to generate, edit, and enhance 9:16 video content using proprietary AI algorithms and third-party models. By using the Studio you acknowledge that:

AI-generated or AI-enhanced outputs are provided for creative and productivity purposes only.
You remain responsible for reviewing and approving any generated content before publishing.
EZpresence may process your uploaded media to provide video rendering, captions, voice-overs, or avatar synthesis.
EZpresence does not guarantee the accuracy, realism, or fitness of generated results for any specific purpose.

9. Service Availability and Modifications

EZpresence strives to provide continuous, reliable service but does not guarantee uninterrupted availability.
We may occasionally modify, update, or discontinue features to improve the user experience or comply with API or AI model changes by partner platforms.

We reserve the right to make such changes without prior notice.

10. Intellectual Property

All intellectual property on the EZpresence platform — including software, branding, text, graphics, algorithms, AI systems, and interfaces — belongs to EZpresence or its licensors.
You may not copy, modify, or distribute our content or AI-generated outputs without proper authorization or compliance with platform policies.

11. Third-Party Services

EZpresence integrates with third-party services (such as Google, Meta, TikTok and others) and may leverage third-party AI technologies.
These services are governed by their own terms and privacy policies, which you should review.
EZpresence is not responsible for the actions, data practices, or service availability of any third-party provider.

12. Account Termination

You may terminate your account at any time from the Settings page. We may suspend or terminate accounts that:

Breach these Terms,
Abuse connected APIs or AI models, or
Engage in fraudulent, unlawful, or malicious activity.

Upon termination, your stored data will be deleted in accordance with our retention policy.

13. Disclaimer of Warranties

The EZpresence Service is provided "as is" and "as available."
We make no warranties, express or implied, regarding reliability, uptime, or fitness for a particular purpose.
AI-generated results, including videos and voice-overs, are experimental in nature and may not always perform as expected.
Your use of the Service is at your own risk.

14. Limitation of Liability

To the fullest extent permitted by law, EZpresence and its affiliates are not liable for:

Any indirect, incidental, or consequential damages,
Loss of data, revenue, or business opportunities,
Or any damages arising from unauthorized access, AI inaccuracies, or content misuse.

In no event shall EZpresence's total liability exceed the amount paid by you (if any) in the preceding 12 months.

15. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms shall be resolved in the competent courts of Tel Aviv, Israel.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, integrations, or legal requirements.
When we make significant updates, we'll notify users via the website or email.
